The reality show celebrity and model on Wednesday filed a case the clothing store and its founder company, The Gap Inc., in a Los Angeles federal court accusing their ads defied her promotional rights with ads that highlight a woman who looks same to her.
A video of a televise ad marking a smiling, dark-haired woman who bears a similarity to the genuine Kardashian has been viewed in excess of two million times on Old Navy's YouTube channel.
Kardashian's proceeding says customers may be puzzled by the ads and the model's real endorsements, which include her own clothing store and shoe line. An ad, titled, "Super C-U-T-E," started broadcasting in February and Old Navy is quiet using some of the advertisements, the lawsuit states.
The case quotes all the benchmarks of modern personality: her eight million followers on Twitter, over five million fans on Facebook and placing as one of the most explored -for celebrities on the Internet.
Kardashian "has invested extensive time, energy, funds and consumerist endeavor in creating her significant professional and commercial gains and success, as well as in developing her recognition, fame, and importance in the public eye," the lawsuit describes.
Louise Callagy, a spokeswoman for San Francisco-based Gap said the company has not yet notice the case and had no remarks.
Kardashian, 31, has rapid increased to fame in present years after acquiring importance as a friend of Paris Hilton and for having a sex tape. She shows along with her family on the E! Entertainment Television series "Keeping Up With the Kardashians" and usually graces magazine covers.
Her file’s case is observing indefinite damages and desires a federal judge to avert Old Navy from using a Kardashian similar model in its ads again.
The model in the ads, Melissa Molinaro, is not named in the lawsuit. She articulated frustration that the similarity was being pointed out again. "Were (sic) still talking about this," she posted on Twitter, noting the ad ran five months ago. "Some people have too much time on (their) hands."
